Lawyer's Oath (Alberta)

and the politicians swear to the same queen; so they are each committing fraud by saying we have a democracy and a constitution; when all we have is slaves of the queen, who belong to the masons.

No ACCOUNTABILITY- how is articulating students at the law societys supposed to find lawyers guilty of offences and then hope to become one themselves?. I have complained to the law society of a lawyer colaberating to withould evidence in fixing a court case and all they say is that until a judge rules they did something wrong they will do nothing.

i dont think you will find your boogey man. The police, the government, the lawyers, the judges........you seem to be against anyone with authority. The world must turn, and these people do their best. Yes they make mistakes, yes there are bad apples, but no more then bad plumbers, mechanics, nurses, etc. stop looking for people to blame.

sober up, get a job, pay your taxes, and just try and be happy.

I promised in another thread to find and reproduce the oath that I took as a lawyer in Alberta. I figured it made sense to put it in a topic of it's own. I'll leave it to someone else to start the discussion based on the content of the oath itself.

I, [insert name of lawyer], of the City of [insert place of residence], in the Province of Alberta, do swear that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth II her heirs and successors according to law, that I will, as a barrister and solicitor, conduct all causes and matters faithfully and to the best of my ability. I will not seek to destroy anyone's property. I will not promote suits upon frivolous pretenses. I will not pervert the law to favour or prejudice anyone, but in all things will conduct myself truly and with integrity. I will uphold and maintain the sovereign's interests and that of my fellow citizens according to the law in force in Alberta. So help me God.

If you are swearing allegiance to a Queen then asking for help from God ; what does that make you?

Don't you believe god created everyone sovereign and equal?

The Queen pays me to post that lawyers and judges do their job. I am not going to take any position contrary to the one I'm paid to take.

See, what is fatal to all of the fine opinions here is the fact that the “Oath of Allegiance” is in itself a mechanism to avoid accountability. In that the Alberta version is malformed and fails to hold any adherence to that which is specifically required for federal recognition. The federal doctrine states clearly “...and no other. 

...and this then allows for section 15 of the C.C.C. to be introduced. 

Anyway, do some research people.

Lawyers help lots of Canadians make money. Got a union,got a contract raise? Thank a lawyer. Own a company that merged and increased in value because of it? Thank a lawyer. Didn't get screwed when you bopught your house.......?

I'm biased though, about a third of my income is derived from law firms.......

I did get screwed by my lawyer. I bought a rental propertyin 2013, tried to sell it 5 yrs later only to find out he did'nt check the zoning. It was sold to me as a triplex. the city had letters on file from 1997 saying that the renovations were against code. He also took out a title ins. Policy that is worthless because he did'nt do his proper checks. When I approached him and said fix it by making a claim to your errors and omissions ins. he basically said piss off and sue me. Now I'm struggling to find another lawyer to sue him.

I am an Ontario lawyer who took a similar oath and technically new Canadian citizens do during their ceremony.

I quite frankly think no matter what words are drafted in an oath someone will find them a problem.

Any direct mention to  to God in any oath technically could be challenged by an atheist using the Charter resulting in them being allowed to swear an alternative oath not mentioning God but FTA or other lawyers chip in, I am not aware of a lawyer who has done a Charter challenge with a Bar oath.

As for reference to the Queen as Rem pointed out the Queen is just a symbol for the meaning of the state itself. Any other meaning is not its intent and reflects the views of those who have their own additional contexts they add. In law, the references to the Queen simply mean the state.

As for any of these oaths they just intend to have us swear we won't break the very laws we are supposed to defend.

Now, some lawyers are crooked, corrupt, others are honest and hard working. In all professions are good and bad and a mix of both.

Lawyers are hated because of the inherent nature of the work, arguing one view for someone when someone else argues another view. Necessarily lawyers anger people they act against. Also law is an intangible service. Lawyers charge for hours of work but you can not see the work, only the results, and the results are either seen as losing or creating documents no one really wants.

All that said, I do not get hung up on the words of any oath. To me the most important person I owe telling the truth to starts with me. If that isn't inside me like an inner voice guiding me on what is the right thing to do, I could not do the job, and I teach that.

I leave the opinions stated alone. Everyone has a right to question any oath. I get why people don't like lawyers the same way they feel uncomfortable with undertakers or in my case any doctor with a glove telling  me to bend over.

I have spent years and mega bux funding or executing legal proceedings that the Canadian legal profession did not have the integrity or balls to pursue or actually do within either the law or any sense of common decency or within ethical limits.

Are there some good guys/gals in the legal profession?   Yeah, but few of those will stay around due to the huge conflict when they realize the realities of what actually goes on.

BTW:  we are involved in another such case of significant importance in the US now, so the 49th is no limiting factor.

If, as the OP and others have claimed that we owe some great debt of gratitude to those who are SWORN to uphold the law, my position is you will get that recognition when you clean up the filth and shit in your own cage first.

Before you think I am going off on the legal profession alone:  my own opinion is that maybe 5% of ANY profession is populated by those who are genuinely competent and maybe 1% who are selflessly dedicated.
